Waiver of Liability and Photo Release

By completing and signing this form, I hereby waive, release, and discharge any and all claims and damages for personal injury, death, or property damage that I or my minor children may sustain or which may occur as a result of my own participation, or that of my minor children, with Clay Ground LLC.

I further understand and agree that:

1. Liability Release: This release is intended to discharge in advance Clay Ground LLC, its owners, officers, employees, contractors, directors, agents, and successors from and against any and all liability, except for their sole negligence or intentional acts, connected in any way with my participation or my minor children’s participation in Clay Ground LLC activities.

2. Activity Risks: Such activities may be hazardous, strenuous, and/or physical in nature, potentially causing injuries. Participation in these activities may result in injury, death, or property damage.

3. Voluntary Participation: Knowing the risks involved, I voluntarily request permission for myself or my minor child to participate in these activities.

4. Assumption of Risk: I hereby assume all risks of injury, death, or property damage and release and hold harmless Clay Ground LLC, its officers, employees, contractors, and agents, except for their sole negligence or intentional acts.

5. Binding Agreement: This waiver, release, and assumption of risk is binding on me, my heirs, and assigns.

6. Indemnification: I will indemnify and hold Clay Ground LLC harmless from any loss, liability, damage, cost, or expense, including litigation, which it may incur as a result of any injury and/or property damage that I or my minor children may sustain while participating in these activities.

7. Compensation for Losses: I will compensate Clay Ground LLC for any loss, damage, or cost it may incur if any litigation arises due to any claim made by myself, said minors, or by anyone on said minor’s behalf.

8. Non-Child Care Activities: Activities are not child care as defined by the Commonwealth of Virginia, and Clay Ground LLC is not responsible for unattended children on the premises.

9. Photo & Video Release: I expressly allow, and hereby waive any objection to, Clay Ground LLC photographing and/or videotaping me and/or my minor children when participating in Clay Ground LLC programs. I understand and agree that all photographs and videotapes will remain the property of Clay Ground LLC and that they may use such photographs or videotapes for archival and promotional purposes.

 

MASKING:

We use the CDC metric called COVIS-19 County Check, which is a tool to help communities decide what prevention steps to take based on the latest data in their area. Levels can be low, medium, or high and are determined by looking at hospital beds being used, hospital admissions, and the total number of new COVID-19 cases in an area. We will adjust health protocols accordingly.
